Welcome to L&R Brands LLC, which includes but is not limited to HonourMark (“our”, “us”, “we”).  Please review the following Terms of Use Agreement (“Agreement”), which explains to customers (“you”, “your”) the use of this site.  By visiting our site, you are accepting the practices described in this Agreement.    

General

We expressly disclaim any duty to update the materials on the site, although we may modify the materials at any time.  We will inform you of changes via email or posting a notice on our site.  By continuing to use our site, you are consenting to the revised Agreement.  If any provision of this Agreement is unlawful, void or unenforceable, the remaining provisions of the Agreement will remain in place.

We reserve the right to change or refuse any order you place with us.  In the event we modify an order, we will attempt to notify you.  We reserve the right to change or discontinue the site, any products, or promotions offered, with or without notice and/or offer opportunities to some or all users. 

Intellectual Property Rights

All materials on the site, registered or unregistered, including, but not limited to logos, photographs, designs, and page headers (“Contents”) are the property of L&R Brands LLC and are protected by copyright, trademark, and other applicable proprietary rights and laws.  Our clothing designs, including but not limited to logo styles and locations, distinctive decorative elements or designs, and slogans (“Designs”) are the property of L&R Brands LLC, are protected by copyright, trademark, and other applicable proprietary rights and laws, and may also be protected by patent.

Our site and the Contents are solely intended for personal, non-commercial use.  No right, title, or interest in any Contents is transferred to you as a result of downloading, copying, or sharing via social media.  You may not display, publish, transmit, modify, claim authorship of, create derivative works from, or sell Contents or Designs in any way other than for personal use. 

Prohibited Behavior

You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc., that overburdens our servers or ability to maintain the site.  You agree neither to collect nor harvest any personally identifiable information, including account names, from the site, nor to use any communications systems or links to social media sites provided by our site for any commercial solicitation purposes. You further agree not to use any portion of the site as a destination linked from any unsolicited bulk messages or unsolicited commercial messages.  In addition, you agree not to engage in any of the following prohibited actions: (1) attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from our servers; (2) taking any action that imposes, or that we believe in our sole discretion may impose an unreasonable or disproportionately large load on our server infrastructure; (3) uploading invalid data, viruses, worms, or other software agents to our servers; (4) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding, or attempting to hide your identity; (5) interfering with the proper working of the site; or (6) bypassing the measures that we may use to prevent or restrict access to our site.  This list is not intended to be comprehensive, and we may at our discretion revoke access to our site at any time based on other behaviors or for other reasons.

Product Descriptions

We attempt to be as accurate as possible with our product descriptions such as colors and measurements.  Occasionally there may be information on our site that contains errors that may relate to product descriptions, pricing, promotions, and availability.  We reserve the right to correct any errors without prior notice. 

Links to Other Sites

Our site may contain links to third party sites that are not under our control and do not constitute our endorsements.  We assume no responsibility for the linked sites.

User Feedback and Other Submissions

You are responsible for all feedback and other submissions disclosed (collectively, "Comments").  You agree that any Comments you make shall not violate any third party proprietary rights nor contain obscene material.  All Comments submitted on this site shall constitute an assignment to us of any and all worldwide, proprietary rights and shall not be limited in any way in our use, commercial or otherwise. 

We are not obligated (1) to respond to any Comments; (2) to compensate you for any Comments; and/or (3) to keep Comments confidential.  We have the right to edit or remove any Comments.

Returns

We offer free shipping for returns.  If you need a different size, received the wrong item, or are dissatisfied with your purchase for any reason, please visit our Returns Center for assistance.  If a product is returned showing evidence of extensive wear, damage, or soiling, we may at our sole discretion deny a refund or exchange for the product.

Disclaimer

The materials on this site are provided "as is" without warranties of any kind, either express or implied, including without limitation, warranties of title, implied warranties of merchantability, fitness for a particular purpose or non-infringement of intellectual property.

Your use of the site is at your sole risk, and you assume full responsibility for any costs associated with your use of the site.  We shall not be liable for any damages of any kind related to your use of the site.

Indemnification

You agree to defend, indemnify, and hold harmless L&R Brands LLC and/or any of its affiliates, owners, officers, directors, employees and/or agents from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the site.

Choice of Law

This Agreement shall be governed, construed, and enforced in accordance with the laws of the State of California, without regard to its conflict of laws rules.  You agree to bring any dispute arising under this Agreement exclusively in the State and Federal courts of the State of California in the City and County of San Francisco.

Termination

This Agreement is effective unless and until terminated by L&R Brands LLC.  We may terminate this Agreement at any time without notice and deny you access to the site, if in our sole discretion you fail to comply with any provision of this Agreement, or if we for any reason otherwise so decide to terminate.
